Welcome to ClickGym! By accessing or using our platform, mobile application, or services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

ClickGym is a fitness platform that connects users with partner gyms and fitness facilities. Our Service includes:

• Day, weekly, and monthly gym pass purchases
• QR code-based gym check-in system
• Gym discovery and search functionality
• User account management and payment processing
• Customer support and dispute resolution

3. User Accounts

3.1 Account Creation

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4. Gym Passes and Bookings

4.1 Pass Types

• Day Passes: Single-use access to a specific gym facility
• Weekly Passes: Unlimited access for 7 consecutive days from purchase
• Monthly Passes: Unlimited access for 30 consecutive days from purchase

4.2 Pass Usage

Gym passes are non-transferable and valid only for the specified gym and time period. You must present your QR code or member code for gym access. Failure to check in properly may result in denied access.

4.3 Cancellations and Refunds

Day passes may be cancelled up to 2 hours before intended use for a full refund. Weekly and monthly passes may be cancelled within 24 hours of purchase for a full refund, minus a processing fee. No refunds are available for partially used multi-day passes unless required by law.

5. Payments and Billing

5.1 Payment Processing

All payments are processed securely through our third-party payment providers. By making a purchase, you authorize us to charge your payment method for the total amount due.

5.2 Pricing

Gym pass prices are set by individual gym partners and displayed at the time of purchase. Prices may vary based on location, time, and demand. All prices include applicable taxes unless otherwise stated.

6. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Share or resell gym passes or access codes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users or gym staff

7. Gym Policies and Rules

Each partner gym maintains its own policies, rules, and operating hours. You agree to comply with all gym-specific rules and policies. ClickGym is not responsible for individual gym policies, equipment availability, or facility conditions.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by ClickGym and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without express written permission.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

We strive to provide uninterrupted service but cannot guarantee 100% uptime. The Service is provided "as is" without warranties of any kind, either express or implied.

9.2 Limitation of Liability

To the maximum extent permitted by law, ClickGym shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless ClickGym and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately, but paid-for unused passes may remain valid subject to their original terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
